1. Scope and provider

These General Terms and Conditions govern the contractual relationship for orders placed through www.dascoli.ch.

The provider and contracting party is Dascoli Pharma AG, Münchhaldenstrasse 10, 8008 Zurich, Switzerland. The ordering platform is operated by Stauffacher Apotheke, Birmensdorferstrasse 1, 8004 Zurich, a business of Dascoli Pharma AG. Stauffacher Apotheke carries out the pharmaceutical review and processing of orders and dispenses the medicinal products ordered.

Orders may be placed only by adults with a delivery address in Switzerland and must be intended for the patient’s personal use. Any terms of the customer apply only if Dascoli Pharma AG has expressly accepted them in writing.

By submitting an order, the customer confirms that they have read and accepted the version of these Terms and Conditions in force at the time of the order.

2. Product information, orders and conclusion of contract

The presentation of products and services on the ordering platform is not a binding offer; it is an invitation to place an order. Product information, prices and availability may change.

Before submitting a binding order, the customer can review and correct the information entered. Submission constitutes a binding offer to enter into a contract. Receipt of the order is confirmed electronically without delay. This acknowledgement of receipt does not constitute acceptance.

A contract is concluded only when Stauffacher Apotheke, following its pharmaceutical and legal review, expressly accepts the order or confirms dispatch. If only part of an order is accepted, the contract is concluded only for the confirmed items.

Stauffacher Apotheke may reject an order or limit the quantity dispensed, in particular for pharmaceutical or legal reasons, if information is incomplete or inaccurate, if a prescription is missing or invalid, if a product is unavailable, if coverage remains unresolved, or if misuse is suspected. The customer will be informed; payments already received for items not supplied will be refunded.

3. Prescriptions, controlled substances and pharmaceutical review

Medicinal products are dispensed and dispatched only if all legal requirements are met and a valid prescription has been provided in the required form. Stauffacher Apotheke may at any time require the original prescription or direct transmission by the prescribing medical professional.

Controlled substances require a valid controlled-substance prescription that complies with all applicable formal and transmission requirements. An uploaded document or information entered on the platform does not replace a legally required original where the law requires one.

The customer must provide all information required for review and dispensing completely and accurately. This includes, in particular, the prescription issue date, patient details, medicinal product, dosage, quantity, directions for use, and relevant information about health, allergies, intolerances and medicinal products used at the same time.

Repeat supplies under repeat or long-term prescriptions are made only within the prescription’s validity period, the permitted number of supplies and the remaining quantity. Stauffacher Apotheke may contact the patient or the prescribing medical professional, delay dispensing, limit the quantity or refuse dispensing where required for medication safety or legal compliance. Stauffacher Apotheke’s pharmaceutical assessment determines whether a product may be dispensed.

4. Prices, insurance billing and payment

All prices are stated in Swiss francs (CHF), including statutory VAT. Before the order is submitted, the price and identifiable additional charges, including delivery costs and applicable pharmacy tariffs or service-based remuneration, are displayed. Statutory prices and tariffs apply to benefits covered by compulsory health insurance.

Where the relevant requirements are met, benefits may be billed directly to the health insurer (tiers payant) or to the customer (tiers garant), depending on the applicable insurance model. The customer authorises Dascoli Pharma AG to verify insurance details and coverage and to obtain any required cost approval.

Benefits not covered by insurance, as well as deductibles, co-payments, rejected coverage and amounts that cannot be billed because insurance information is incomplete or inaccurate, are payable by the customer.

For self-pay orders, the payment methods shown during checkout are available. Dascoli Pharma AG may restrict individual payment methods, require advance payment or carry out a credit check for payment by invoice. Invoices are payable by the stated due date. Statutory default interest and reasonable reminder and collection costs may be charged in the event of late payment.

5. Availability, delivery and dispatch

Deliveries are made only to permitted delivery addresses in Switzerland. Special delivery conditions may apply to certain medicinal products, particularly controlled substances or products requiring refrigeration, including personal handover, identity verification, signature or a specified delivery window.

Delivery times are non-binding estimates. Delays may arise in particular from pharmaceutical clarifications, missing documents, supply shortages, cold-chain requirements or events outside Dascoli Pharma AG’s reasonable control.

Partial deliveries are permitted where reasonable for the customer and provided they do not result in additional standard delivery charges. If a product is unavailable or cannot be dispensed, the customer will be informed. There is no obligation to supply the relevant item, and payments already made for it will be refunded.

The customer is responsible for complete and accurate delivery information and for accepting delivery. If a shipment cannot be delivered for reasons attributable to the customer, the reasonable additional costs incurred may be charged.

6. Cancellation and returns

An order may be cancelled as long as pharmaceutical processing, individual preparation or preparation for dispatch has not begun. Cancellation must be communicated without delay using the contact channels indicated on the platform.

There is no general right of withdrawal or return. For reasons of medicinal-product and product safety, dispensed medicinal products and other health products are generally not taken back or returned to stock. Returns remain possible in the event of an incorrect delivery, a proven defect, a recall or a mandatory legal obligation.

Medicinal products may be returned to the pharmacy for professional disposal. This does not create a right to reimbursement.

7. Inspection, defects and warranty

The delivery must be checked upon receipt. Incorrect deliveries, transport damage, missing items or visible defects should be reported to Stauffacher Apotheke immediately and no later than five days after receipt. Hidden defects must be reported without delay after discovery.

In the event of a justified defect, Dascoli Pharma AG will decide, taking medicinal-product safety into account, whether to provide a replacement, remedy the defect or issue a refund. Mandatory statutory rights remain unaffected.

8. Use of products and liability

Medicinal products must be used only in accordance with the prescription, pharmaceutical advice, professional and patient information, and medical instructions. Information on the ordering platform does not replace individual medical or pharmaceutical advice.

Dascoli Pharma AG has unlimited liability for loss or damage caused intentionally or through gross negligence, for death or personal injury, and in all other cases in which liability may not lawfully be restricted or excluded.

In all other cases, liability is, to the extent permitted by law, limited to direct loss or damage that was foreseeable when the contract was concluded. Liability for indirect or consequential loss, loss of profit, or interruptions affecting telecommunications, payment, hosting, transport or other services supplied by independent third parties is excluded where Dascoli Pharma AG is not responsible for the interruption.

9. Electronic communications

Dascoli Pharma AG and Stauffacher Apotheke use the contact details provided for order acknowledgements, queries, delivery information, invoices, safety notices and other contract-related messages.

Unencrypted email and SMS can involve security and confidentiality risks. Prescriptions, health data and other confidential content should therefore be transmitted only through the secure channels provided for that purpose. The customer must keep their contact details up to date.

10. Data protection

The processing of personal data is described in the Privacy Policy for www.dascoli.ch, which forms an integral part of these Terms and Conditions.

11. Amendments

Dascoli Pharma AG may amend these Terms and Conditions at any time. The version published when an order is submitted applies to that order. Material changes affecting existing contractual relationships will be communicated in an appropriate manner.

12. Governing law and jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods and conflict-of-laws rules. Subject to mandatory statutory places of jurisdiction, the courts of Zurich, Switzerland, have jurisdiction.

If the language versions differ, the German version prevails.
